Letter to Texas Representative

 I am actively seeking a Texas Representative to sponsor, develop and refine the Innocent Tears Act to make it into the law.  Texas law has a flaw and that flaw undermines our parents’ and children’ constitutional and natural God given right to be together.  Many innocent tears are dropped due to unwarranted separations of young children with their parents, children so young that they can not even understand what is happening and why they are being taken from their parents.

Over the past several years I have been a victim of the “reason to believe” policy that is destroying my life and my children’s lives, where simple allegations of the people that have never even been to my house and statement “it’s in the best interest of the child” are being used as a reason to remove the children from my custody.  Once they are removed, DFPS starts conducting a year, year-and-a-half long interrogations into the accusations and when those accusations are baseless, DFPS says that the parents are “not cooperating”, “being defensive” and “guarded”, denying reunification over and over no matter how hard you try to end this nightmare. 


All it takes to start a DFPS case is one person willing to hurt you.  I have a clean record, I can pass any background check and I am a good person.  But in the eyes of DFPS I am a “criminal”, I have no rights, I have no privacy, I have no freedom, no right to Grand Jury and I and my child are to be confined within the DFPS imprisonment undergoing multiple interrogations, tests and separations as long as they see fit with only “reason to believe” with no evidence of any kind, not even a record of the initial interviews they have conducted to start the so-called “investigation” that is more of a witch hunt against parents. 


During the present investigation I, my husband and my children have suffered Amendment IV, Amendment V and Amendment VIII Bill of Rights violations already.  DFPS’ personnel are acting outside federal law but within our own Texas Law that is currently allowing DFPS agents and their contractors to violate parents’ and children’ natural right to be together by allowing easy separations with no need for evidence of any kind, as the law states that “allegations” and stating that separation is “in the best interest” of the child is “sufficient” to petition or motion for “termination of parental rights”.


  This shall not be allowed!  This can change and this has to change, and YOU have the power to change it.  Parents are not criminals.  They may be tired, overwhelmed, they may have made a mistake, or even many mistakes, but not many people out there want to hurt their children. 


 Texas law the way it is worded right now is letting DFPS hurt our children, it’s hurting the parents, it’s breaking apart family units, it’s causing mental dysfunctions and separations.  In the age of mental crisis it is time that the lawmakers take charge of that crisis by fixing the laws that were made to protect our children.  In reality these laws ended up becoming job security machines where lawyers, DFPS personnel, DFPS contractors, counselors, psychologists, laboratories and many other services have consistent flow of income and funding with “in the best interest” and empty “allegations” as a “reason to believe” and reason to continue to separate families, provide services and continue causing unimaginable pain to parents and their children.   


  There are ongoing police reforms to improve our law enforcement policies, it is time to have a DFPS reform to improve the laws regarding this parent oriented police force that is operating outside the Constitution of our otherwise strong country.  DFPS policies and procedures are breaking the most important fabric of our society.  The building blocks of every strong healthy society are healthy families.  And the families are not healthy when the families are separated.  The kids are not healthy when they are forced to miss their parents.  The parents are not healthy when they are forced to miss their kids.  And the society is not healthy when thousands of children and parents are crying themselves to sleep. 


Texas DFPS Reform is a necessity to keep our state strong.  And it starts with the very beginning, with the law that lets DFPS attain easy separations, with a procedure to “petition for termination of parental rights” and with “Innocent Tears Act” to change it. 


In conclusion:  I am not against DFPS and their services, I am against unnecessary separations between children and parents and in most cases these separations are unnecessary.  If we can pass the Innocent Tears Act - separations like mine will become obsolete. 


DFPS aim needs to change into making families stronger and being a support system that can provide care to those that need it and resources to those in need, they should concentrate on working with the family by keeping the children with their parents together, becoming a “friend” of a family, a shoulder to lean on, not a domestic terrorist organization that they have become by taking and holding hostage the most important people in our lives - our children.
