In times of Artificial Intelligence, fake videos, made up phone calls and many other alterations of physical evidence one agency who needs absolutely no evidence to take all your rights is DFPS.  They don't even have to get creative and try to make some up. 

The current Texas law Family Code, Section 161.101. Petition Allegations; Petition and Motion Requirements (a) states: "A petition for the termination of the parent-child relationship is sufficient without the necessity of specifying the underlying facts if the petition alleges in the statutory language the ground for the termination and that termination is in the best interest of the child."

What is an allegation? 

By the definition an allegation is a claim or assertion that someone has done something illegal or wrong, typically one made without proof.  

And even though the law claims that clear and concise evidence is needed in order to take your parental rights, current Texas Law gives DFPS permission to take your child without any evidence or burden of proof.  DFPS does not care to take your rights, they care to take your children so this modern day child trafficking system keeps on moving and making money for those involved in this "funding laundering" machine.

Sounds harsh?  Maybe, but it's true.  They take the child and they all go to work on "fixing" the alleged by someone "underlying facts".  The services are paid by the funding of the people, longer the services - more funding is needed, more "cases" they have - more funding they get. 

Because my ex is claiming that my husband is "evil" DFPS couldn't wait to send me to HEART, the organization that helps abused women to overcome their abusive relationships, encourages women to get self-esteem, get more control over their lives and be more affirmative with their boundaries.  There - it hit me: I know who my abusers are and it is not my husband.  It is my ex and his weapon of choice to destroy my life - DFPS. 

HEART has helped me realize my boundaries!  I am done taking emotional abuse from all these people, I am done letting them smother me and my husband with dirt and I will "one day at a time" work on spreading the word and promoting long needed DFPS reform. Enough is enough! 

It is enough smothering parents with "reason to believe" empty allegations, it is enough taking children from their families for little or no reason and it is enough operating outside the Constitution and the Bill of Rights.  These practices have to stop.  These practices are splitting apart families, hurting people and teaching our children to run away from the issues they may encounter (or cause) in life and hide from them, instead of seeking solutions and building stronger bonds and relationships. 

No service I have ever encountered while working with DFPS required separation of the family - all of the services would be best efficient with the family intact as a whole.  We have to work together towards DFPS reform to make sure that allegations would not be enough to take someone's child and the children can stay with their parents and work through obstacles the family encountered together. 

Jealousy, hatred, money and pride fuel these investigations.  Discrimination, desire to be right, desire to be a good guy and desire to punish make these cases last.  I say discrimination because you will not see many people with attorney on retainer that will have a DFPS case, not that they are any better than other parents, but because they have the money to make the case stop before it even starts. 

I recently heard about a cognitive bias that describes the human tendency to remember the first piece of information we encounter more accurately and take it as truth not paying as much attention to the information that is presented later. 

It appears that all DFPS cases are subject to that bias.  They hear an allegation, they know that the allegation is all they need to start the case and the investigation ends right there and right then.  No need to investigate any further, no need to listen to the accused, no need to check the facts or for any of that "presumption of innocence" nonsense. 

Based on the allegations first DFPS tried to make me into a criminal, when that didn't work they tried to make me into a victim; after I got engaged I got accused of being held hostage by my fiance, next time we were accused of not feeding the kids, having an accident we didn't have, saying words we didn't say, doing things we didn't do and making threats we didn't make - "in the best interest of the child", because of all the previous allegations, we have been deemed "repeated offenders".  Something that I see as repeated victims of the system in place and reason to believe policy that is letting DFPS take our children every time someone makes an empty unsupported by any evidence allegation. 

Promote DFPS reform!  Fight for the right to be parents again and to have the freedom to parent our children!  Fight for parents and children constitutional right to life and liberty together. 

Reach out to your Texas Representatives with outcry that this law needs to change and promote development and sponsorship of Innocent Tears Act to stop "reason to believe" allegations without physical evidence. 

There is no harsher punishment for a parent than losing a child and there is no harsher punishment for a child than losing the parent.  Let's work together to stop this medieval practice once and for all!
